Terms & Conditions

1. Acceptance of Terms

By downloading, accessing, or using the Spraybook mobile application ("the App"), you agree to be bound by these Terms and Conditions and our Privacy Policy. If you do not agree with these Terms and Conditions, please do not use the App.

2. App Description

Spraybook is a mobile application designed to help Australian farmers create and maintain accurate spray records, ensuring compliance with Australian laws and regulations. The App allows users to input and access data whenever and wherever they need it, providing a streamlined solution for chemical application management.

3. User Responsibilities

As a user of Spraybook, you are responsible for:

  • Providing accurate and up-to-date information when creating your account and using the App.
  • Maintaining the confidentiality of your account login details and ensuring that your mobile device is secure.
  • Complying with all applicable laws and regulations related to chemical application management.

4. Data Collection and Privacy

  • Spraybook collects personal information, including your full name, email address, and approximate location, to provide personalized weather reports and enhance your app experience.
  • Spray records, farm details, operator names, contact details, and other regularly entered data are also collected and stored securely in Firestore, a Firebase database located in Sydney, Australia.
  • Anonymous diagnostic information is collected to ensure smooth operation and improve the App's performance.
  • Please refer to our Privacy Policy for more information on how we collect, use, and protect your data.

5. Intellectual Property

The App and all its content, features, and functionality are owned by Spraybook and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

6. Service Availability and Disclaimer

Spraybook is provided on an "AS IS" and "AS AVAILABLE" basis. We do not warrant that the App will be uninterrupted, error-free, or completely secure. The App may be subject to limitations, delays, and other problems inherent in the use of the internet and electronic communications.

7. Limitation of Liability

To the maximum extent permitted by applicable law:

  • Spraybook shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, revenues, data, use, goodwill, or other intangible losses.
  • Our total liability to you for all claims arising from or relating to the App shall not exceed the amount you have paid us in the twelve (12) months preceding the claim, or $100 AUD, whichever is greater.
  • We disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
  • Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability, so these limitations may not apply to you.

8. Loss of Spray Records

Spraybook shall not be held liable if spray records become lost due to user deletion or loss of access to the App. It is the user's responsibility to maintain and backup their spray records. We encourage users to regularly export their data to ensure the availability of their records outside the App.

9. Force Majeure

We shall not be liable for any failure or delay in performance under these Terms which is due to fire, flood, earthquake, pandemic, government action, war, terrorism, or other causes beyond our reasonable control.

10. Indemnification

You agree to indemnify and hold harmless Spraybook, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorney's fees, arising out of or in any way connected with your use of the App or violation of these Terms.

11. Termination

We may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms and Conditions. Upon termination, your right to use the App will cease immediately.

12. Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

13. Governing Law

These Terms and Conditions shall be governed and construed in accordance with the laws of Australia, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Australia.

14. Changes to Terms and Conditions

We reserve the right, at our sole discretion, to modify or replace these Terms and Conditions at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. Your continued use of the App after any such changes constitutes acceptance of the new Terms.
